Introducing the Cladding Safety Scheme (CSS)

The Cladding Safety Scheme is designed to address the issue of unsafe cladding on buildings 11 metres and over in England, particularly in cases where a responsible developer cannot be identified, located, or held accountable.

Originally launched as the Medium Rise Scheme (MRS) in November 2022, the initiative underwent a rebranding to the Cladding Safety Scheme in June 2023 and the pilot phase was expanded to encompass buildings taller than 18 metres. This initiative is overseen by Homes England, the government’s delivery agency.

The CSS provides funding for remediation or mitigation of life safety fire risks associated with externally cladded walls in buildings where a responsible developer cannot be identified, located, or held accountable for repairs.

Responsible entities, including freeholders, head leaseholders, right-to-manage companies, resident management companies, or registered providers of social housing, can apply for funding.

Given the proportional relationship between building height and risk to life, buildings under 11 metres are generally considered to pose lower life safety risks. Therefore, extensive remediation is unlikely to be necessary for such buildings.

However, in rare cases where remediation is required, legal avenues for redress are available through the Building Safety Act 2022, enhancing the rights of building owners and leaseholders to seek compensation for substandard workmanship.

Following a successful pilot period, the CSS is now fully operational. Eligible buildings ranging from 11 to 18 metres in height in England, as well as new funding applications for buildings taller than 18 metres outside of London, can now access the scheme.
